SOFTWARE LICENSE FOR ADMWIN. BEFORE PURCHASING THE SOFTWARE, READ THE TERMS AND CONDITIONS OF THIS LICENSE AGREEMENT. WHEN YOU ORDER, YOU ARE AGREEING TO TO THIS LICENSE AGREEMENT AND ALL ITS TERMS.

END-USER SOFTWARE LICENSE AGREEMENT

SECTION 1. SCOPE OF LICENSE
Wennstrom Software grants to you a non-exclusive right to use the "AdmWin" software program (the "Software").

  • Personal license - the Software may be used by the registered person only. The software can be used on any computer that the license holder uses. The license holder may use the software to manage any machine in any domain. The license cannot legally be shared or transferred to another person or user.
  • Domain license - the Software may be used in the registered Windows domain, on any machine, by anyone in the registered organization. It is only possible to manage machines that belongs to the registered domain. The program is locked to the domain name you provide when registering.
  • Site license - the Software may be used at the registered site, on any machine in any domain, by anyone in the registered organization. Site = contiguous property under the control of the organization. "Contiguous property" includes property that is separated only by a public right-of-way (e.g., roadway or power line).
  • Enterprise license - the Software may be used across the entire organization; on any machine, by anyone in the registered organization, anywhere in the world.

SECTION 2. NO COMMERCIAL EXPLOITATION
You may not commercially exploit the Software in any of the following ways:
1) rent, lease or sell the Software
2) offer the Software on a pay-per-play basis
3) distribute the Software for money or other consideration without a license.
4) commercially exploit the Software.

SECTION 3. NO ILLEGAL USE
You agree that your use of the Software will comport and comply with all applicable federal, state and local laws.Wennstrom Software retains the right, if given notice of use of the Software in breach of this material term of the license, to rescind this agreement.

SECTION 4. RESTRICTIONS
Wennstrom Software does NOT give you any right to distribute, electronically or otherwise copies of the Software. You agree that you shall not (a) modify, translate, reverse engineer, decompile, disassemble or otherwise attempt to discover any source code or underlying trade secrets pertaining to the Software, (b) reproduce the Software, (c) modify, market, sublicense, or distribute the Software, or (d) remove any proprietary notices or labels on the Software

SECTION 5. TITLE AND RIGHTS NOT GRANTED RETAINED BY WENNSTROM SOFTWARE
Title, ownership rights, and intellectual property rights in the Software shall remain in Wennstrom Software. The Software is protected by copyright and other intellectual property laws and by international treaties. Title and related rights in the content accessed through the Software is the property of the applicable content owner and is protected by applicable law. Wennstrom Software retains all rights not explicitly granted by the terms of this license agreement.

SECTION 6. TERM AND TERMINATION.
This license agreement shall become effective upon use of the Product and shall continue in force until terminated as provided herein. This license shall terminate immediately if you fail to comply with any of its terms. Upon termination of this license, you shall confirm you have destroyed all copies of the Products in your possession.

SECTION 7: DISCLAIMER OF WARRANTY.
The Software is provided "AS IS", without warranty of any kind, including without limitation the warranties that the Software is free of defects, merchantable, fit for a particular purpose or non- infringing. The entire risk as to the quality and performance of the Software is borne by you. Should the Software prove defective in any respect, you and not Wennstrom Software assume the entire cost of any service and repair. Wennstrom Software does not guarantee that the information the Software provides is correct in any way.

SECTION 8. LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT,
OR OTHERWISE, SHALL WENNSTROM SOFTWARE BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES.

SECTION 9. MISCELLANEOUS
THE ACCEPTANCE OF ANY PURCHASE ORDER PLACED BY YOU IS EXPRESSLY MADE CONDITIONAL ON YOUR ASSENT TO THE TERMS SET FORTH HEREIN, AND NOT THOSE IN YOUR PURCHASE ORDER.

This agreement shall be governed by and construed under European Union law.
